Welcome to Ubeku! These Terms and Conditions govern your use of our marketplace platform, which enables users to buy and sell products, as well as arrange delivery services via our driver app. By accessing or using the App, you agree to be bound by these Terms and Conditions.

1. Acceptance of Terms

By registering for and using Ubeku, you agree to comply with these Terms and Conditions, as well as any applicable laws and regulations. If you do not agree to these Terms, you must not use the App.

2. User Accounts

To use the App as a seller or a buyer, you must create an account. You may become a seller by providing your business details and completing the necessary verification process. As a seller, you are responsible for providing accurate product listings, descriptions, and pricing information.

3. Seller Responsibilities

As a seller, you agree to:

• List only legitimate and authorized products for sale.
• Maintain accurate and up-to-date information regarding your business and products.
• Be responsible for pricing, delivery terms, and product descriptions.
• Ensure that all products comply with applicable laws and regulations.
• Provide excellent customer service, addressing any inquiries or issues related to your products.

4. Buyer Responsibilities

As a buyer, you agree to:

• Provide accurate and complete information when making a purchase.
• Pay for products in accordance with the agreed-upon price.
• Acknowledge that all purchases are final unless otherwise stated.

5. Purchasing Process

Once a buyer selects a product and confirms the purchase, the seller is notified to process the order. The buyer can choose between pick-up or home delivery. If home delivery is selected, the admin will assign a driver to pick up and deliver the product to the customer’s location.

6. Delivery and Driver Responsibilities

• Pick-Up: The driver will collect the product from the seller’s location.
• Home Delivery: The driver will deliver the product to the buyer's specified delivery address. Delivery times may vary depending on location and availability.
• Driver Conduct: All drivers are expected to maintain professionalism and adhere to the company's guidelines during the delivery process.

7. Fees and Payments

• Sellers may be subject to service fees for using the platform.
• Buyers are responsible for paying the price of the products, including any applicable taxes, delivery charges, and service fees.
• All transactions will be processed through the payment method selected at checkout.

8. Prohibited Activities

Users of the App are prohibited from:

• Engaging in fraudulent or illegal activities, including the sale of prohibited or counterfeit goods.
• Using the App to harass, defame, or infringe on the rights of other users.
• Attempting to gain unauthorized access to the App’s systems or data.

9. Privacy and Data Collection

We are committed to protecting your privacy. By using the App, you agree to our Privacy Policy, which outlines how we collect, use, and protect your personal information.

10. Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms and Conditions. This may include suspension of access to the marketplace, deletion of listings, or removal from the App.

11. Dispute Resolution

In the event of a dispute, we encourage you to contact our customer support team to resolve the issue. If the dispute cannot be resolved amicably, it will be subject to the laws and regulations of India.

We may update or modify these Terms and Conditions at any time. Changes will be posted on this page with an updated date. Continued use of the App after modifications indicates your acceptance of the revised Terms.

13. Limitation of Liability

Ubeku is not liable for any indirect, incidental, or consequential damages arising from the use of the App or services provided. We are not responsible for any issues related to the products sold by sellers or the delivery process.

14. Governing Law

These Terms and Conditions are governed by the laws of India, without regard to its conflict of law principles.
